we continue to see those with little power getting punished the most, to make examples out of them, while those with power and money get away with the most egregious of activities (legal or not).
it's unclear that modding costs nintendo, rather than actually expanding their reach (much like we saw with windows 95).
we also see little being done to those who purchased the mods. symbolic punishment seems very distasteful and it's unclear it even works.
